Alleged pizzeria Papa Johns had been staring down the barrel of a class action TCPA lawsuit back before Thanksgiving of last year.
However, 2013 brings some exciting new developments/changes: For one, that class-action suit has been dropped by the plaintiff. However, all this means is: Eileen J. Downing (no relation) will proceed on her own.
The class action suit had alleged that Papa Johns Pizza sent out text message blasts to customers through the mass texting service OnTime4U. Plaintiff(s) alleged that they sometimes received 15 or 16 text messages in a row, sometimes in the night, for a grand total of 500,000 unwanted texts.
According to the press release announcing the cessation of the class action suit, “After investigation and many substantive exchanges regarding the evidence of consent and Papa John’s opt-in procedures, Plaintiff agreed to dismiss all class claims against Papa John’s. The Court entered an order dismissing the TCPA class claims. The case is now limited to Plaintiff’s individual claims.”
