Today, February 11, 2013, The National List of Attorneys published a white paper on debt collection law in Colorado, written by attorneys David Silverman & Anne-Marie Vos, and their law firm Silverman/Borenstein, PLLC.

David graduated Cum Laude with a B.A. in Psychology from California State University, Northridge, in 1978, and he subsequently earned his Juris Doctor from Loyola Law School, Los Angeles, CA, in 1982. From 1982 to 1983, he was an associate attorney for a Los Angeles creditors’ rights law firm, Lederer & Kotler. He opened The Silverman Law Firm in December, 1983, focusing on commercial litigation, retail and commercial collections, business counseling, real estate law and conflict resolution. He merged with The Law Offices of Irvin Borenstein to create Silverman/Borenstein PLLC in 2010. Ninety percent of the practice is dedicated to debt collection.

David is the current, founding President of the Colorado Creditors Rights Association (CCBA). He has been an active member of the National Association of Retail Collection Attorneys (NARCA) since 1995 and served two terms as a member of its Board of Directors. He is also a member of the Debt Buyers Association (DBA International), the National Association of Subrogation Professionals (NASP), the Colorado Bar Association, the Arapahoe County Bar Association and ACA/MAP (ACA International Members’ Attorney Program).

David says that in the 30 years he has been doing debt collection work, he thinks it is interesting how little the public and the media understand about the importance of the debt collection industry and why it plays such a critical role in our economy. He also told National List that one thing creditors need to know that makes debt collection unique in Colorado is, “We are a ‘Serve First’ state, allowing us to serve the consumer with a lawsuit prior to incurring the cost of filing it with the Courts.”

David lives in Greenwood Village, CO, with his wife and three children, ages 18, 21 and 24. When he’s not working, he enjoys golfing, snowboarding, the Broncos and the Rockies. The thing he enjoys most about his work is his colleagues and their friendships.

Anne-Marie graduated from Georgetown University with a B.A. in History in 2005 and earned her Juris Doctor in 2009 from Notre Dame Law School. She has practiced law in Colorado since 2009 and joined Silverman/Borenstein, PLLC in the spring of 2012. She dedicates 100 percent of her practice of law to debt collection. She belongs to the Colorado Bar Association, the Young Lawyers Division, and the Denver Bar Association.

By practicing debt collection law Anne-Marie has learned, “…that a smile and an understanding nod can turn an upset defendant into a willing negotiator”. The part of her job she enjoys most is the contact with people from all over the state of Colorado.

One thing Anne-Marie thinks creditors need to know about debt collection in Colorado is, “The Colorado Court of Appeals recently overturned a state court case limiting the statute of limitations to three years for unsecured debt, specifically medical debt. The statute of limitations is back to six years. This area could still be in flux and bears watching.”

As a resident of Denver, Anne-Marie enjoys the outdoors, particularly skiing in the winter and hiking in the summer. She also supports the Salvation Army and Metro Volunteer Lawyers. She is a newlywed of just a year and a half.
