Kansas Debt Collection Laws: Kansas, as Big as you Think

Today, February 26, 2013, The National List published the white paper on debt collection law in Kansas, written by associate attorneys Dustin Stiles and Rick Milone under the direction and supervision of James McNeile, of the law firm Cohen McNeile & Pappas, P.C. The firm has been a member of The National List since 1994.

Debt buyers beware! There is one law in Kansas that is unique and that sometimes catches debt buyers by surprise. The Kansas Legislature has ruled that a debt buyer cannot garnish a debtor’s wages under K.S.A. 60-2310(d). Dustin Stiles

Dustin Stiles relocated from Nebraska to join the firm as an associate in 2011. Rick Milone has been an associate with the firm since 2008. Together they’ve prosecuted hundreds of hearings and trials before numerous state, federal, and appellate courts throughout each of Kansas and Missouri. Because they co-authored both the Kansas and Missouri white papers, today we will tell you more about Dustin, and on March 11th, when Missouri’s white paper is published, we’ll tell you more about Rick.

Dustin received his J.D. from Creighton University. He began his law career with Cohen McNeile & Pappas. His practice of law is 100 percent dedicated to debt collection. Time spent in court is what he enjoys most about his job. As he works in both Kansas and Missouri, he thinks that another thing creditors need to know is that, “In Kansas a witness must present for introduction of business records evidence over a hearsay objection, while in Missouri business records evidence can generally be admitted through a business records affidavit.”

Dustin lives in Kansas City, Kansas. He is a member of the Kansas City Metropolitan Bar Association (KCMBA) and the Kansas Credit Attorney Association. When not working he enjoys exercising and attending sporting events. He is married with a one-year-old child.
